      Examples of possible unfair, deceptive and abusive acts or practices in marketing to avoid include, but are not limited to:

      • Falsely claiming credentials, licensing or to be a signatory to any set of code of conduct;
      • Falsely misrepresenting affiliation with a person or entity;
      • Advertising payday loans or installment loans as long-term debt solutions;
      • Directing marketing material to jurisdictions where products or services are not provided;
      • The use of threats, intimidation or profane or obscene language;
      • Disclosing or receiving, for consideration, unencrypted consumer account numbers for use in telemarketing;
      • Failing to transmit or cause to be transmitted the telephone number, and, when made available by the telemarketer's carrier, the name of the telemarketer, to any caller identification service in use by a recipient of a telemarketing call;
      • Causing any telephone to ring, or engaging any person in telephone conversation, repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number.

      If an advertisement includes reference to any "trigger terms," additional specific disclosures are required. For the avoidance of doubt, the use of "trigger terms" is prohibited in this MaxLend Campaign.

      • "Trigger terms" and additional disclosures for open-end loans are as follows:
        • Information pertaining to charges imposed is a "trigger term."
          • Negative as well as affirmative references trigger the requirements. Examples include advertisements that state:
            • "No interest;"
            • "Small Monthly service charge on remaining balance;"or
      • Additional required disclosures include:
        • Any minimum, fixed, transaction, activity or similar charge that could be imposed;
        • Any periodic rate that may be applied expressed as an annual percentage rate, and if
        • the plan provides for a variable periodic rate, that fact shall be disclosed; and
        • Any membership or participation fee that could be imposed.
          • The amount of any periodic payment is another "trigger term."
      • "Trigger terms" for closed-end loans are:
        • The amount or percentage of any down payment;
        • The number of payments or period of repayment;
        • The amount of any payment; and
        • The amount of any finance charge.

      Creative Guidelines

      Affiliates can only use the creative assets provided by Merchant. If you would like to use other assets, you must receive written approval by Merchant prior to using. Violation of this policy may result in loss of commissions or termination from the program. You must abide by these terms and conditions at all times, including the requirements below.

      • Creative assets will be available within the Affiliate Network portal. If additional assets are required, please contact your designated Merchant contact to request type, size, and advise whether the asset should be static or animated.
      • Affiliates are not to use the term "Official Site" or any phrase or word with that connotation in their ad copy or website content (example: "MaxLend Official Site".
      • The term "no credit checks" and the use of APR rates or prices cannot be included in promotions (examples: "Only $9.31 per $100 loaned", "No Credit Checks")
      • Affiliates can only promote via e-mail communication at this time to their existing customer base and only after prior written approval by Merchant; please reach out to your designated Merchant contact for more information
      • Affiliates cannot advertise on websites containing adult content, sexually explicit content or ads, or illegal or demeaning content or websites that promote violence, discrimination based on race, religion, sexual orientation, national origin, disability or age.
      • Affiliates cannot change any link coding
      • Using copyrighted or registered icons is NOT permitted unless provided by Merchant
      • All information should be represented fairly and accurately
      • Display URLs must represent the actual landing page where traffic is being sent
      • Affiliates are prohibited from using the brand term in any part of the URL when sending traffic to your site
      • Affiliate agrees not to use SPAM, spyware, parasiteware, or adware
